Eminent Domain

Eminent Domain is the concept that the City, County, State and/or Federal Government may condemn your property and take possession without your consent. When this happens there is usually a “tender” for the amount they value your property at which is paid into the Court. Many times this amount is inadequate and a lawsuit will be had to determine the true fair market value of the property. This is the most commonly seen type of Eminent Domain litigation although there are complexities that exist within this field of law that go far beyond this brief note. More rarely, there are suits to block the taking of property.
